Privacy Statement and Terms of Sale

Thank you for visiting our website. This document contains two parts: our Privacy Statement, which explains how we collect and use information, and our Terms of Sale and Service, which govern orders placed through our website. It applies to www.danielshomecenter.com and any other websites that post it (however accessed, whether by computer, mobile device, or otherwise) (the "Sites"), which are owned and operated by Daniel's Home Center Furniture, Inc. ("Daniel's Home Center," "we," "our," or "us"). It also applies to any widgets, applications, interactive features, or downloads that we own or operate and make available through the Sites. It does not cover information collected at other websites or offline, unless we say so specifically.

Please read it carefully. By using the Sites, you agree to these terms.

BY USING THE SITES OR SUBMITTING PERSONAL INFORMATION THROUGH THE SITES, YOU EXPRESSLY CONSENT TO THE COLLECTION, USE, AND DISCLOSURE OF YOUR PERSONAL INFORMATION AS DESCRIBED IN THIS DOCUMENT.

Part 1: Privacy Statement

Information You Provide to Us

We may ask you to provide, or give you the opportunity to provide, certain categories of information, including: (1) personally identifiable information, meaning information that can reasonably be used to identify you, such as your name, email address, phone number, birth date, payment card number, and physical address ("Personal Information"); and (2) demographic information, such as gender or zip code ("Demographic Information"). We may collect this information through forms on the Sites, including account registration, wish lists, sweepstakes and contest entries, email and text message sign-ups, checkout, and any other time you communicate or interact with us. Demographic Information is not treated as Personal Information unless it is combined with Personal Information in a way that identifies you, in which case we treat it as Personal Information.

Information We Collect Automatically

We and our third-party service providers may use a variety of current and future technologies that automatically collect certain information when you visit or interact with the Sites ("Usage Information"). Usage Information may include your browser type, the URL that referred you to the Sites, the pages you visit, and the time of your visit. We use Usage Information to operate and improve the Sites and your experience on them. We also collect your IP address or another unique identifier for the device you use to access the Sites (a "Device Identifier"). Whenever we associate Usage Information or a Device Identifier with your Personal Information, we treat it as Personal Information.

Technologies We Use

  • Cookies: A cookie is a small data file placed on your device when you visit the Sites. Cookies may be used to remember you and your preferences, keep items in your cart, and track visits to our pages. If you disable cookies, some features of the Sites may not work properly.
  • Web Beacons: Small graphics or code (also called "clear GIFs" or "pixels") may be included in our web pages and emails. They may be used to count visitors, understand how people navigate the Sites, and measure how many emails were opened or links were clicked.
  • Embedded Scripts: An embedded script is code that collects information about your interactions with the Sites, such as the links you click. It is downloaded temporarily from our server or a service provider, is active only while you are connected to the Sites, and is deactivated or deleted afterward.

Purchases and Third-Party Services

We may contract with third parties for services such as payment processing, order fulfillment, and delivery. You may be directed to a third party's website to complete part of your order. Those websites are governed by their own privacy policies, not this one.

Information from Other Sources

We may supplement the information we collect online with information from other sources, such as address-validation services or information you gave us in one of our retail stores, to better serve you, tailor our content, and offer products or services we believe may interest you. This information may be combined with information from other online and offline sources. We will treat any Personal Information we receive according to this Privacy Statement unless we state otherwise.

How We Use Information

We may use your Personal Information, Demographic Information, and Usage Information to: (1) provide the products, information, or services you request, process transactions, and send you newsletters, special offers, or promotional materials from us or third parties; (2) let you participate in features of the Sites such as sweepstakes, message boards, user-generated content, and other interactive features; (3) process your registration, including verifying your email address; (4) improve the Sites and our services, customize your experience, and show you the most relevant content; (5) contact you about your use of the Sites, your orders, and changes to the Sites or our policies; (6) detect and prevent fraud and protect the security of the Sites; (7) carry out internal business purposes; and (8) for any other purpose disclosed when you provide your information or described in this document.

How We Share Information

We may share Usage Information and Demographic Information with third parties. Except as described below, we do not share your Personal Information with third parties for their own marketing purposes unless you consent when you provide it. We may share information as disclosed when you provide it and as described here:

  • When You Agree to Receive Information from Third Parties: You may be offered the chance to receive information or offers directly from third parties. If you agree (or do not decline, where applicable), your Personal Information will be shared with them and will be governed by their privacy practices.
  • Service Providers: We use third-party vendors to perform services on our behalf, such as hosting the Sites, operating site features, analytics, payment processing, order fulfillment, delivery, and sending email and text messages.
  • Co-Branded Areas: Some areas of the Sites may be offered together with third parties and may require you to provide Personal Information to register or access products.
  • Sweepstakes, Contests, and Promotions: We may offer promotions through the Sites that require registration.
  • Legal and Safety Reasons: We may disclose information when we believe it is required by law or legal process, or necessary to protect our rights, property, customers, or the security of the Sites, including to prevent fraud.

Mobile Terms of Service (Text Messaging)

The Daniel's Home Center mobile message service (the "Service") is operated by Daniel's Home Center. By using the Service, you agree to these terms ("Mobile Terms"). We may modify or cancel the Service or any of its features without notice. To the extent permitted by law, we may also modify these Mobile Terms at any time, and your continued use of the Service after the effective date of a change means you accept it.

By consenting to our SMS/text messaging service, you agree to receive recurring text messages from and on behalf of Daniel's Home Center through your wireless provider at the mobile number you provided, even if that number is registered on a state or federal Do Not Call list. Messages may be sent using an automatic telephone dialing system or other technology. Service messages may include updates and alerts such as order updates and account alerts. Promotional messages may include promotions, specials, and other marketing offers, such as cart reminders.

You do not have to sign up for this program to make a purchase, and your consent is not a condition of any purchase. Participation is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan or contact your wireless provider for details.

You may opt out at any time by texting the keyword STOP to +18339212749 or by clicking the unsubscribe link (where available) in any message. You will receive a one-time opt-out confirmation, and no further messages will be sent unless you initiate them. For help, text HELP to the same number or contact us using the information below.

Part 2: Terms of Sale and Service

Online Orders: Our Rights and Your Responsibilities

By placing an order through the Sites, you agree to the following terms. These terms apply in addition to any other policies posted on the Sites, such as our return, delivery, and warranty policies.

1. Order Acceptance and Our Right to Cancel

Your order is an offer to purchase. It is not accepted until we confirm it and, where applicable, ship or make the item available for pickup or delivery. An order confirmation email or order number is an acknowledgment that we received your order and does not guarantee acceptance. Daniel's Home Center reserves the right, at our sole discretion and without prior notice, to refuse, limit, or cancel any order, in whole or in part, at any time before delivery, including after an order has been confirmed or your payment has been authorized. Reasons for cancellation may include, but are not limited to:

  • the item is out of stock, discontinued, or otherwise unavailable;
  • an error in the price, description, image, promotion, or other information about the item;
  • suspected fraud, unauthorized or unverifiable payment, or failure to pass payment or identity verification;
  • inability to reach you to verify your order, delivery address, or delivery requirements;
  • an address that is outside our delivery area or cannot be serviced;
  • orders that appear to be placed by dealers, resellers, or competitors, or that exceed reasonable quantities or stated limits;
  • a violation of these terms or misuse of the Sites or any promotion; or
  • events beyond our reasonable control.

If we cancel an order after payment has been collected, we will refund the amount charged to your original payment method. Refunds may take several business days to appear, depending on your bank or card issuer. Our sole obligation in the event of a cancellation is to refund any amount you paid for the canceled portion of the order.

2. Pricing and Typographical Errors

Daniel's Home Center is not responsible for misprinted sale prices and typographical errors. This applies to pricing, product descriptions, images, specifications, promotions, and any other content on the Sites or in our advertising. We reserve the right to correct any such error at any time, including after an order has been submitted, and to cancel any order affected by an error. If an item is listed at an incorrect price, we may, at our discretion, either contact you for instructions or cancel the order and refund your payment. We are not required to sell an item at an incorrectly published price.

3. Limited Quantities and Substitutions

Advertised items are limited in quantity. Sale items are available while supplies last, and we do not offer rain checks unless required by law. We reserve the right to limit quantities per customer or per household. We also reserve the right to substitute an advertised item with a comparable item. If we substitute an item, we will make reasonable efforts to notify you before delivery.

4. Product Appearance

Color, fabric, and finishes may vary from images. Colors displayed on your screen depend on your monitor and device settings, and natural materials such as wood, leather, stone, and fabric vary from piece to piece and from lot to lot. Product dimensions, weights, and specifications are approximate. We strongly recommend that you visit one of our showrooms to see and feel materials and finishes in person, and that you measure your space, doorways, stairways, and elevators before ordering.

5. Availability and Delivery

Product availability is subject to change without notice, and inventory shown online may not reflect real-time availability. Delivery and pickup dates are estimates only and are not guaranteed. We are not liable for delays caused by manufacturers, carriers, weather, or other circumstances outside our control. You are responsible for providing an accurate delivery address and for ensuring that the delivery location is accessible. Additional charges may apply for rescheduled, missed, or failed delivery attempts, or for delivery conditions that were not disclosed at the time of the order.

6. Payment

You represent that you are authorized to use the payment method you provide and that the information you supply is accurate and complete. We may authorize or charge your payment method at the time of your order or at any time afterward, and we may require additional verification before we accept or ship an order. You are responsible for all applicable taxes, fees, and delivery charges. If your payment is declined or reversed, we may cancel your order.

7. Promotions and Discounts

Promotions, coupon codes, and discounts are valid only for the stated period, may be limited to certain products, and cannot be combined with other offers unless we say so. We reserve the right to modify or end any promotion at any time and to cancel or adjust any order placed using a promotion that was used improperly or in error.

8. Returns and Warranty

Returns, exchanges, and cancellations by customers are governed by our return and cancellation policies as posted on the Sites or provided at the time of sale. Some items, including custom, special-order, clearance, and final-sale items, may not be eligible for return or cancellation. Manufacturer warranties, where applicable, are provided by the manufacturer. Except as required by law, we make no additional warranties, express or implied, regarding products sold through the Sites.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DANIEL'S HOME CENTER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITES OR ANY ORDER, AND OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT AT ISSUE. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

10. Changes to These Terms

We may update this document at any time by posting the revised version on the Sites with a new "Last Updated" date. Your continued use of the Sites after a change means you accept the updated terms. Orders are governed by the version in effect at the time the order is placed.

Dispute Resolution and Mandatory Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

YOU AND DANIEL'S HOME CENTER AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO YOUR USE OF THE SITES OR THE PURCHASE OF ANY PRODUCTS FROM DANIEL'S HOME CENTER (COLLECTIVELY, "DISPUTES") SHALL BE RESOLVED EXCLUSIVELY BY BINDING ARBITRATION, RATHER THAN IN COURT, except that you may bring claims in small claims court if they qualify.

The arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. Payment of all filing, administration, and arbitrator fees will be governed by the AAA's rules.

WAIVER OF JURY TRIAL: BY AGREEING TO ARBITRATION, YOU AND DANIEL'S HOME CENTER ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION. The arbitrator has the authority to grant motions dispositive of all or part of any claim, to award monetary damages, and to grant any non-monetary remedy or relief available to an individual under applicable law, the AAA rules, and this agreement.

CLASS ACTION WAIVER

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND DANIEL'S HOME CENTER AGREE THAT ANY PROCEEDING TO RESOLVE OR LITIGATE ANY DISPUTE WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS. YOU AGREE THAT YOU WILL NOT SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, A REPRESENTATIVE ACTION, A COLLECTIVE ACTION, A PRIVATE ATTORNEY GENERAL ACTION, OR IN ANY PROCEEDING IN WHICH YOU ACT OR PROPOSE TO ACT IN A REPRESENTATIVE CAPACITY.

NO ARBITRATION OR PROCEEDING WILL BE JOINED, CONSOLIDATED, OR COMBINED WITH ANOTHER WITHOUT THE PRIOR WRITTEN CONSENT OF ALL PARTIES TO ALL AFFECTED ARBITRATIONS OR PROCEEDINGS.

Governing Law and Venue

These terms, and any separate agreements under which we provide you services or products, are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

You agree that any action at law or in equity arising out of or relating to these terms that is not subject to arbitration shall be filed only in the state or federal courts located in Orange County, California, and you irrevocably and unconditionally consent and submit to the exclusive jurisdiction of those courts.
